Terms of Service

Effective Date 20/10/2026

PLEASE READ THESE TERMS CAREFULLY

These Terms of Service (the "Agreement" or "Terms") constitute a legally binding agreement between you and Odds Made Us(“OMU”, “we”, “us” or “our”), which govern the relationship and serve as an agreement between you and us and set forth the terms and conditions by which you may access and use our OMU mobile application, any related websites, content, features, products and services (collectively, the "Service"). By registering for an account, accessing or using the Service, you agree to these Terms. If you do not agree, you must not access or use the Service. The English version of these Terms is authoritative.

Changes to this Agreement. We may amend these Terms and any policies incorporated into them from time to time. We will provide reasonable advance notice of material changes by email to the address associated with your account or through a prominent in-app notice. Material changes may include changes to fees or paid benefits under our control, material changes to how personal data is collected or used, or new AI-powered features materially affecting users or their personal data. If changes are reasonably necessary to comply with law, address an urgent security or safety issue, prevent fraud, or protect the Service, we may make them effective sooner and notify you as soon as reasonably practicable. Non-material changes may take effect when the revised Terms are published. The effective date will be stated in the revised Terms.

To the extent permitted by applicable law, your continued use of the Service after revised Terms take effect constitutes acceptance of those Terms. If you do not accept the changes, you must stop using the Service and may delete your account. Deleting your account does not cancel 同頻 Plus. You must cancel your subscription separately through Apple. Neither notice nor continued use replaces any separate consent required under applicable data protection law. Apple App Store rules and applicable law govern changes to subscription pricing and billing.

1. Who May Use Our Services

1.1 The Service is an adult social discovery platform. Our Privacy Policy and any Community Guidelines published within the Service apply to your use of the Service and are incorporated by reference where permitted by law. Purchases made through the Apple App Store are also subject to Apple's applicable terms.

1.2 You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, and have the legal capacity to enter into these Terms. You may use the Service only where it is lawful for you to do so.

1.3 By using the Service, you represent and warrant that (a) you satisfy the age and legal eligibility requirements; (b) the information you provide is accurate; (c) you are not prohibited by law from using the Service; (d) you have not been convicted of a sexual or serious violent offence; and (e) you have not previously been removed from the Service unless we have expressly authorised your return.

1.4 If we reasonably suspect that you do not meet the age requirement, we may immediately restrict or terminate your account. We rely on information provided by users and do not guarantee independent age verification. Parents and legal guardians should take appropriate steps to prevent minors in their care from using the Service.

1.5 The Service offers interactive games, a sync score, profile discovery, hearts, connections designated as "Soulmates", chat and other social features. These are social and entertainment functions, not professional psychological assessments or guarantees of a particular result. Some features may involve adult-oriented discussion topics.

1.6 The sync score reflects an in-app game experience only. It does not measure, certify or predict emotional, psychological, romantic or long-term compatibility. A heart indicates interest but creates no obligation to respond. "Soulmate" is an in-app connection label and does not mean that we have verified compatibility or endorsed a relationship.

1.7 Profile discovery and visibility may depend on user preferences, activity, technical factors and Service settings. We do not guarantee that you will be shown any particular user, that others will see your profile, or that you will receive messages, hearts, matches or other engagement. Where location features are available, their use is subject to the permissions and settings described in our Privacy Policy.

1.8 We may introduce, modify, restrict, suspend or discontinue Service functions, subject to applicable law and any obligations relating to benefits already purchased. We may display advertising, sponsored content and promotions within the Service, subject to applicable law and our Privacy Policy.

2. Intellectual Property and Licence to Use Services

2.1 We or our licensors own all rights, title and interests in the Service, including its software, source code, interfaces, original games and questions, designs, text, graphics, databases, trade names, logos, trademarks and other intellectual property, excluding content owned by users or third parties.

2.2 Subject to these Terms and applicable Apple usage rules, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install, access and use the Service on Apple-branded devices that you own or control for personal, lawful and non-commercial purposes.

2.3 Except where permitted by applicable law or expressly authorised by us in writing, you must not reproduce, extract, copy, modify, distribute, sell, sublicense, frame, mirror, decompile, reverse engineer or create derivative works of the Service or its content. You must not use our name, branding, logos or trademarks without our prior written permission.

2.4 All rights not expressly granted to you are reserved by us or our licensors. We may investigate and take appropriate action against unauthorised use of our intellectual property or the Service.

3. Privacy Policy

3.1 Our Privacy Policy, available through the Service, describes the categories of personal data we collect, how we use, share, protect and retain them, the use of authorised service providers, and the rights and choices available to you. Our Privacy Policy forms part of the rules governing your use of the Service to the extent permitted by law.

3.2 Where applicable law requires a separate notice, consent or other lawful basis for processing personal data, these Terms do not replace that requirement. If you do not wish to provide information required for a particular optional feature, do not use that feature. Certain core account information is necessary to provide the Service.

3.3 Questions, requests or complaints concerning personal data may be directed here.

4. Account Registration and Optional Selfie Verification

4.1 You must provide accurate and current account information. Unless expressly authorised by us, you may maintain only one account, may use it only on your own behalf, and must not sell, transfer, share or allow another person to use it. We may close duplicate accounts or accounts created to circumvent restrictions or bans.

4.2 You are responsible for safeguarding access credentials and for activity conducted through your account, except to the extent caused by our breach of a legal duty. You must promptly notify us here if you suspect unauthorised access or misuse.

4.3 Your profile may contain photographs, descriptions, preferences and other information you choose to supply. Information designated as public or visible to other users may be viewed and saved by those users. Do not include financial account details, identity documents or other sensitive personal information in publicly accessible profile fields.

4.4 Selfie verification is optional. If you choose to participate, we or our authorised verification service providers compare the submitted verification selfie with your profile images for a limited consistency check and for related safety and fraud prevention purposes. A verification badge may be displayed when the review is successful.

4.5 We delete submitted verification selfies within 90 days after the verification review is completed, unless a longer period is reasonably necessary for a specific fraud or safety investigation, a legal claim or compliance with a legal obligation. Exceptionally retained images will be subject to periodic review and deleted when no longer necessary. We may retain limited verification outcomes and audit records for account integrity, security and legally permitted purposes, as described in our Privacy Policy. We do not use verification selfies for unrelated advertising or unrelated AI model training.

4.6 We may reject, withdraw or require repetition of a verification where submitted images appear inconsistent, manipulated, unauthorised or otherwise unreliable. We do not guarantee that every user has been verified.

4.7 A verification badge indicates only that the submitted selfie appeared to match the profile images at the time of review. It does not verify legal identity, age, marital status, criminal history, intentions or safety; it is not a criminal background check. You should use caution when communicating with or meeting other users, whether verified or not.

5. Term and Termination; Account Deletion

5.1 These Terms take effect when you first access or use the Service and remain in effect for as long as you use the Service or have an account, subject to provisions that survive termination.

5.2 You may request deletion of your account through the account deletion feature in the Service. Deletion is irreversible and may result in the loss of access to your profile, messages, connections, purchased benefits and remaining 同頻幣, subject to your statutory rights and Section 13. On deletion, we will delete associated personal data and user content in accordance with our Privacy Policy and applicable law, subject to legally permitted retention, materials already independently saved by other users, and necessary residual backups that are deleted or made inaccessible in accordance with our retention procedures.

5.3 Account deletion does not cancel a subscription. If you purchased 同頻 Plus, you must cancel it separately in your Apple account subscription settings. Apple may continue billing you until you cancel. We will provide an account deletion reminder about this separate cancellation requirement.

5.4 We may immediately restrict, suspend or terminate your account or access to particular features where we reasonably believe that (a) you have materially or repeatedly breached these Terms; (b) you are underage or have supplied fraudulent information; (c) your conduct may endanger other users, our personnel or the Service; (d) your activity involves fraud, impersonation, harassment, unlawful content or security abuse; or (e) action is required by law or a competent authority. We may take temporary precautionary measures while reasonably investigating a reported incident.

5.5 We may terminate the Service or an individual account for other legitimate operational reasons on reasonable prior notice, subject to applicable law and any payment or refund obligations. Where lawful and appropriate, we may explain the main reason for material restrictions or termination. We may withhold details where disclosure would compromise an investigation, safety, security or a legal obligation.

5.6 You may contact us here to request a review of a restriction or termination. We may ask for additional information. A review request does not guarantee reinstatement or require us to disclose confidential investigation information. A user whose account was terminated for a breach may not register again without our written permission.

5.7 Upon termination, the licence granted to you in Section 2 ends. Provisions concerning virtual items and refunds, disclaimers and liability limitations, content licences, representations, indemnification, intellectual property, dispute resolution and other provisions which by their nature are intended to survive will remain effective to the extent permitted by law.

6. Disclaimers; Limitation of Liability

6.1 Nature of the Service. We provide a technology platform for social discovery and communication. We are not a dating agency, personal safety guarantor, supervisor of meetings, or party to any relationship, financial exchange, agreement or other private arrangement between users. You decide whether, when and how to contact, meet or otherwise interact with other users.

6.2 No verification or outcome guarantee. We do not conduct comprehensive criminal background checks on every user or independently verify every statement, profile, message, identity, age, marital status, intention or history. Optional selfie verification is limited as described in Section 4. We do not guarantee the accuracy of user content, the reliability or safety of any user, any number of views, hearts, messages or connections, or a romantic or other relationship. Games and sync scores are for entertainment and conversation only.

6.3 Interactions and offline meetings. Communications, voluntary disclosures of personal information, payments and in-person meetings involve risks. You should take sensible precautions, particularly when meeting someone in person or discussing money. To the maximum extent permitted by applicable law, we are not responsible for the independent acts or omissions of users or other third parties, including deception, scams, theft, harassment, stalking, violence, assault, bodily injury, death, emotional distress or financial loss arising from their communications or encounters. This provision does not exclude our own non-excludable legal duties.

6.4 Service provided as available. To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available". We disclaim express and implied warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, uninterrupted availability, reliability, accuracy, security and freedom from errors, except to the extent those warranties cannot lawfully be excluded. We do not guarantee that any content or particular feature will remain available or that user content will always be recoverable.

6.5 Third-party services and modifications. We do not control services, networks, products or websites operated by independent third parties. We may change or discontinue features as provided in these Terms and subject to applicable law and obligations relating to purchased benefits.

6.6 Excluded losses. To the maximum extent permitted by applicable law and subject to Section 6.8, neither we nor our affiliates, directors, officers, employees, agents or service providers will be liable for indirect, incidental, special, punitive, exemplary or consequential losses, or for lost profits, business, revenue, goodwill, opportunity or data, whether arising in contract, tort or otherwise, even if informed of the possibility of such loss. This does not exclude a remedy that the law requires us to provide.

6.7 Aggregate liability limit. To the maximum extent permitted by applicable law and subject to Section 6.8, our total aggregate liability arising from or relating to the Service, regardless of the legal basis of a claim, will not exceed the greater of (a) the fees actually paid by you for the Service during the 12 months immediately preceding the event giving rise to the claim and (b) HK$3,000.

6.8 Mandatory exceptions. Nothing in these Terms excludes or restricts liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of a mandatory statutory duty where liability cannot lawfully be excluded or limited; or any consumer, privacy or other statutory right or remedy that cannot lawfully be waived. Any exclusion, limitation or indemnity applies only to the extent it is legally enforceable and, where required, reasonable under applicable law.

7. Code of Conduct; Prohibited Activities

7.1 You must behave lawfully and respectfully when using the Service. You must not:

(a) harass, bully, threaten, intimidate, stalk, exploit or abuse any person; send unsolicited explicit or sexual material; distribute intimate images without consent; or promote hatred, discrimination or violence;

(b) impersonate another person, use another person's images without authorisation, submit a falsified selfie, deliberately misrepresent your identity or age, create deceptive accounts or engage in romance scams, investment scams, cryptocurrency fraud, money solicitation or other deceptive activity;

(c) use the Service while underage, facilitate access by minors, or create, request, exchange or distribute material depicting or encouraging sexual exploitation of minors;

(d) advertise, solicit clients, recruit users, promote competing services, offer paid companionship or sexual services, sell products or engage in other commercial activity without our prior written permission;

(e) post spam, phishing material, malicious links, viruses or harmful code; collect users' information without authorisation; invade privacy or violate the intellectual property or other rights of any person;

(f) use bots, crawlers, scrapers or other unauthorised automated tools; access non-public APIs; probe or exploit security vulnerabilities; bypass technical restrictions or rate limits; manipulate games, location settings, 同頻幣, Boost, subscription benefits or purchases; or interfere with the Service or its infrastructure; or

(g) assist another person in any of the prohibited activities above, or otherwise break applicable law.

7.2 You must not threaten, harass, intimidate or abuse our support staff, moderators, contractors or other personnel. We may take proportionate action against conduct that reasonably threatens our personnel or the orderly operation of the Service.

7.3 We maintain reporting, user-blocking and content-moderation measures to address objectionable material and abuse. You can report a user, profile or message and block another user through the Service. We review reports in a manner proportionate to their seriousness and aim to respond to safety concerns in a timely manner. We prioritise serious threats, suspected exploitation, unlawful intimate imagery, fraud and other grave safety concerns. We cannot guarantee a particular result or disclose confidential information about another user's account.

7.4 We may, where permitted by law, use appropriate automated and human review, investigate suspected misconduct, remove or restrict content, reduce visibility, limit messaging, suspend or close accounts and preserve information reasonably necessary to investigate wrongdoing or defend legal claims. We are not required to wait for a criminal conviction before taking reasonable safety precautions. We do not undertake to review every private interaction in advance, and moderation does not certify anyone as safe.

7.5 We may access, retain and disclose relevant reports, account records and communications where reasonably necessary and lawfully permitted for safety investigations, fraud prevention, the enforcement of these Terms, legal proceedings, compliance with legal process or protection of users and the Service. Personal data will be handled in accordance with our Privacy Policy and applicable law.

7.6 Deliberately false, malicious or abusive reports may themselves violate these Terms. If you believe action was taken against you in error, you may request reconsideration here.

7.7 The Service is not an emergency response service. If you or someone else is in immediate danger, contact the local emergency services. In Hong Kong, call 999. You may separately report safety concerns here.

8. Content Restrictions

8.1 You are solely responsible for information and content that you upload, publish, send, display or otherwise make available through the Service ("Your Content"), including photographs, profile descriptions, game answers and chat messages. You must ensure that Your Content is accurate where relevant, lawful and consistent with these Terms.

8.2 You must not upload or distribute content that is defamatory, fraudulent, threatening, abusive, hateful, discriminatory, unlawfully sexually explicit, sexually exploitative, invasive of privacy or otherwise illegal. You must not submit content that infringes intellectual property rights, reveals another person's private information without authority, includes another person's intimate images without consent, or falsely suggests endorsement by us.

8.3 You must possess all rights, consents and permissions needed to submit Your Content and to grant the licences in Section 9, including permission from any person identifiable in materials you submit where legally required.

8.4 We may remove, disable access to or restrict Your Content in accordance with Section 7, these Terms and applicable law. We may act on a reasonable belief of abuse or infringement and may consider counter-notices or requests for review. Removal or non-removal of content does not imply that we have verified its accuracy or lawfulness.

9. Licences Granted by You

9.1 You retain ownership of the intellectual property rights you hold in Your Content. By submitting Your Content to the Service, you grant us, our affiliates, successors, permitted assigns, contractors and authorised sublicensees, to the fullest extent permitted by applicable law, a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable and royalty-free licence to host, reproduce, copy, store, retain, distribute, transmit, display, perform, publish, translate, edit, adapt, reformat and create derivative works from Your Content in any media, in connection with operating, providing, securing, promoting, analysing, developing and improving the Service and related features or products.

9.2 This licence survives removal of Your Content, closure or deletion of your account and termination of these Terms, to the extent permitted by law. To the extent legally permitted, you waive, or agree not to assert against us and persons authorised by us, moral rights in Your Content insofar as necessary to exercise the rights granted above. You represent that you have the necessary rights and permissions to grant this licence without making us liable to pay third-party royalties.

9.3 You also grant other users a limited, non-exclusive, non-transferable licence to view Your Content that you choose to make available to them through the normal operation of the Service, solely for personal and non-commercial purposes, subject to these Terms.

9.4 The grant of an intellectual property licence does not transfer ownership of Your Content to us or override applicable personal data protection laws, legal rights of erasure or withdrawal of consent. Identifiable personal data will be collected, used, retained and disclosed only on a lawful basis as explained in our Privacy Policy. We will not use private chat messages, verification selfies or an identifiable person's likeness in public advertising without any additional authorisation required by law. Nothing in this Section permits unlimited retention of personal data simply because an intellectual property licence is perpetual.

9.5 If you submit suggestions, ideas or other feedback about the Service, we may use and develop that feedback without payment or obligation to you, subject to applicable law. We may display advertisements and promotional placements within the Service in accordance with Section 14 and our Privacy Policy.

10. Your Representations and Warranties

10.1 For each item of Your Content, you represent and warrant that (a) you own or otherwise control the necessary rights; (b) you are authorised to submit it and grant the licence in Section 9; (c) it does not infringe the intellectual property, privacy, publicity or other rights of third parties; and (d) it complies with applicable law and these Terms.

10.2 You represent and warrant that your account registration, verification information and statements made to us are accurate to the best of your knowledge and that you will promptly correct materially inaccurate information. You must not imply that your profile, statements or actions are sponsored, approved or guaranteed by us.

11. Indemnification

11.1 To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless us, our parents, subsidiaries, affiliates and respective directors, officers, employees, agents, contractors and service providers against third-party claims, legal proceedings, liabilities, damages and reasonable expenses, including reasonable legal fees, to the extent they arise from (a) Your Content; (b) your material breach of these Terms; (c) your violation of applicable law or of another person's rights; or (d) fraudulent, unlawful or otherwise wrongful activity carried out by you through or in connection with the Service.

11.2 This indemnity applies only to loss or liability properly attributable to your conduct and does not require you to indemnify us for our own negligence, wrongful acts or liabilities which cannot lawfully be transferred or excluded. We may, subject to applicable law, take appropriate steps to defend or settle relevant claims and will not recover unreasonable or duplicative expenses from you.

12. Third-Party Copyrights and Other Rights

12.1 We respect intellectual property and other legal rights. If you reasonably believe that material on the Service infringes your copyright or another right, contact us here with (a) your name and contact information; (b) identification of the work or right concerned; (c) sufficient information to identify the allegedly infringing material and where it appears; (d) an explanation of the claimed infringement; and (e) a good-faith statement that the information is accurate and that you are the rights holder or authorised to act for that person.

12.2 We may request further information, remove or restrict material where appropriate, and suspend or terminate repeat infringers in accordance with applicable law and these Terms.

12.3 If you believe that Your Content was restricted or removed by mistake, you may submit a counter-notice here describing the material, your account, the reason you dispute the decision and any supporting evidence. We may review it, notify relevant parties where permitted, and restore or continue restricting content as appropriate. A counter-notice does not guarantee restoration.

12.4 Knowingly false or misleading complaints or counter-notices may result in action under these Terms and may expose the sender to legal liability.

13. Premium Services, Virtual Coins, Boost and In-App Purchases

13.1 同頻 Plus. Certain features require a paid 同頻 Plus subscription available through the Apple App Store. The price, billing period, included benefits and any introductory offer are shown before you confirm your purchase. Apple charges your Apple account in accordance with its payment terms.

13.2 Automatic renewal. 同頻 Plus is an auto-renewing subscription. Unless you cancel it before the applicable renewal deadline, it automatically renews for another billing period and Apple charges the applicable price. Apple generally requires cancellation at least 24 hours before the end of the current period to avoid the next renewal. The precise timing of billing and renewal is governed by your App Store subscription details and Apple's terms.

13.3 Cancellation. You must manage and cancel 同頻 Plus through your Apple account subscription settings. Cancelling renewal generally allows access through the end of the paid period, subject to refunds, revocations, applicable law and Apple's rules. Deleting the app, logging out or deleting your account does not cancel a subscription or stop Apple's recurring charges.

13.4 Prices and features. We may change subscription prices, benefits or future offerings in accordance with these Terms, applicable law and Apple requirements. Subscription price increases and any required customer consent will be administered in accordance with Apple's procedures. We do not guarantee that a particular paid feature will remain unchanged indefinitely. Material reductions affecting prepaid benefits are subject to applicable consumer rights.

13.5 同頻幣. 同頻幣 are limited-use digital items available within the Service. Coins purchased through Apple's in-app purchase system are "Purchased Coins". Coins granted entirely free of charge by us, which are not bundled with, conditional on or part of a paid entitlement, are "Promotional Coins". We may display or account for these balances separately.

13.6 Boost. 同頻幣 can be used for eligible Service functions, including Boost (加速曝光). A Boost temporarily increases the opportunity for your profile to be shown, for the period specified when it is activated. It does not guarantee impressions, profile views, hearts, messages, matches, connections or any result. Once activated, a Boost runs according to the advertised period and generally cannot be paused, transferred or reversed, except where applicable law or Apple requires otherwise.

13.7 Coin expiry. Purchased Coins obtained through Apple in-app purchase do not expire while your account remains active, subject to lawful account deletion, enforcement actions and refund adjustments described below. Unless a different period is clearly disclosed at the time of grant, Promotional Coins expire 90 days after they are credited to your account. Expired Promotional Coins are removed without compensation. Where both types are available, we apply eligible Promotional Coins first unless the Service clearly states otherwise. Expiry dates for Promotional Coins are shown in the Service.

13.8 Nature of coins. 同頻幣 are not money, stored value, legal tender, a bank deposit or a financial instrument. They have no cash value and cannot be redeemed for cash or transferred, gifted, sold or exchanged outside the Service. You receive only a personal, limited, revocable, non-transferable licence to use them as permitted by the Service and these Terms.

13.9 Adjustments and forfeiture. We may correct coin balances credited in error and reverse items obtained through fraud, abuse, unauthorised transactions or improper chargebacks. On voluntary account deletion or termination for a material breach of these Terms, unused coins and uncompleted Boost benefits may be lost, except where applicable law or Apple policy requires a refund, restoration or other remedy.

13.10 Refunds. Purchases of 同頻 Plus and 同頻幣 through Apple are processed by Apple. Refund requests for such purchases should be submitted using Apple's Report a Problem service. Apple determines eligibility under its policies and applicable law. Except where required by law or authorised by Apple, purchases are not refundable merely because you changed your mind, used only part of a subscription period, or did not use purchased coins or Boost.

13.11 Refund review information. Where Apple requests information relevant to a refund review, we may provide limited information about purchase usage or consumption as permitted by law and Apple's procedures, subject to any consent required from you. Our Privacy Policy describes applicable data sharing. Withdrawal of consent, where available, applies to future processing and does not undo lawful disclosures already made.

13.12 Purchase support. If purchased benefits are missing or a purchase cannot be restored, contact us here. We may request transaction information needed to investigate, but we do not require you to provide full payment card details. We will provide remedies required by law or applicable App Store rules.

14. Personal Data and Marketing Communications

14.1 Information shared with other users. The Service enables users to disclose information to one another. Content or personal information that you voluntarily share may be copied, saved, forwarded or misused by the recipient. We cannot control the independent conduct of other users outside the Service and, to the extent permitted by law, are not liable for their unauthorised acts. This does not reduce our own statutory obligations to protect personal data we process or control.

14.2 Data protection. We handle account details, profile information, messages, optional verification information, service activity and other personal data as described in our Privacy Policy. The Privacy Policy explains the relevant purposes, recipients, retention periods or criteria, and ways to exercise applicable rights of access, correction, erasure, objection or other lawful requests. Contact us here with privacy enquiries.

14.3 Direct marketing. Where permitted by applicable law and after the required notice and valid consent or express indication of no objection, we may use your name and contact details to send information about the Service, paid features, special offers, promotions and related social activities. We do not treat mere silence, failure to respond or acceptance of these Terms alone as consent. If we propose to disclose personal data to another person for that person's direct marketing, we will first provide the legally required information and obtain any separate consent required by law.

14.4 Promotional push notifications. We send promotional push notifications only where you have explicitly opted in through a clear choice within the Service. You may withdraw this permission through the Service and may also disable notifications in your device settings.

14.5 Marketing opt-out. You may withdraw consent to marketing without charge at any time through unsubscribe controls, the relevant Service settings or by contacting us here. We will honour valid opt-out requests in accordance with applicable law.

14.6 Service messages. We may send operational, security, verification, transactional, legal or other non-marketing notices when reasonably necessary or legally permitted, even where you have opted out of promotional communications.

15. AI Technologies and Automated Processing

15.1 We may use automated technologies to support features such as profile discovery, recommendations, personalisation, moderation, spam detection, fraud prevention and Service analytics. We may also introduce new AI-powered features from time to time. The availability and operation of particular features are explained through the Service and, where personal data is involved, our Privacy Policy.

15.2 Such technologies may consider information you provide, activity within the Service, user preferences and other relevant signals to generate suggestions or help identify safety risks. Recommendations and automated outputs are not certifications of identity, character, safety or compatibility and should not be treated as professional advice or guarantees.

15.3 Where we use personal data for AI model training, development or improvement beyond the purposes already validly notified, we will provide the required notices and obtain any separate consent or provide applicable objection and opt-out rights as required by law. We may use properly anonymised or aggregated information for product research and improvement where lawful. The licence in Section 9 does not override personal data rights.

15.4 We may use authorised third-party technical providers to support automated features subject to appropriate contractual, confidentiality, security and data protection measures. Personal data will not be used by such providers for unrelated independent purposes unless separately authorised and lawful. Verification selfies are not used for unrelated AI training, as stated in Section 4.

15.5 Where applicable law gives you the right to request information about, object to or obtain human review of a qualifying automated decision, you may contact us here to exercise that right.

16. Third-Party Websites, Services and Apple

16.1 The Service may contain links to third-party sites and may depend on external hosting, authentication, analytics, payment, security or other service providers. Third parties operate under their own terms and privacy notices. Except for our duties under applicable law, we do not control or assume responsibility for their independent content, availability, products or conduct.

16.2 Apple App Store terms. These Terms are entered into between you and us, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Service and its content to the extent required by applicable law. Apple has no obligation to provide maintenance or support for the Service.

16.3 If the Service fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the application, if any, as provided under Apple's terms. To the maximum extent permitted by law, Apple will have no other warranty obligation concerning the Service. We remain responsible for claims concerning the Service, including product liability, applicable legal or regulatory compliance, consumer protection claims and third-party intellectual property claims, to the extent required by law.

16.4 You represent that (a) you are not located in a country subject to a United States Government embargo or designated by that Government as a terrorist-supporting country; and (b) you are not listed on any United States Government list of prohibited or restricted parties.

16.5 Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, are entitled to enforce them against you as third-party beneficiaries. The rights conferred on Apple under this Section do not reduce any non-excludable rights you have under applicable law.

17. General Provisions

17.1 Governing law. These Terms and any non-contractual dispute relating to them or the Service are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of laws principles, subject to any mandatory laws that apply to you in your place of residence.

17.2 Dispute resolution and jurisdiction. Please contact us here first to give us a reasonable opportunity to address any complaint or dispute informally. Subject to applicable mandatory consumer rights and jurisdictional protections, you and we submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region for disputes arising out of or relating to these Terms or the Service.

17.3 Individual proceedings. To the maximum extent permitted by applicable law, you and we agree that claims arising from the Service or these Terms will be brought on an individual basis and not as a plaintiff, claimant or member of a class, collective or representative proceeding, and each party waives participation in such proceedings to the extent the waiver is enforceable. This does not deprive either party of mandatory statutory rights to collective or representative relief or access to the courts. If this clause is unenforceable in any jurisdiction, the remainder of these Terms continues in effect.

17.4 Interpretation, severability and no waiver. Section headings are for convenience. If a provision is unlawful, invalid or unenforceable, it will be interpreted or severed to the minimum extent necessary, and the remaining provisions continue in effect. Our failure or delay to enforce a right does not waive that right or any other right. Our rights and remedies are cumulative to the extent permitted by law.

17.5 Notices and contact details. We may deliver contractual, legal and Service notices electronically through the Service or to the email address associated with your account, subject to applicable law. You are responsible for keeping that address current. Legal notices to us should be sent here unless applicable law requires another method.

17.6 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, restructuring, sale of the business or transfer of assets, subject to applicable law and without reducing any non-excludable rights you have.

17.7 Entire agreement and amendments. These Terms, together with the Privacy Policy and any Community Guidelines incorporated by reference, comprise the entire agreement between you and us in relation to the Service, subject to mandatory legal requirements and applicable Apple purchase terms. Amendments take effect as described at the beginning of these Terms. No amendment proposed by you is binding on us unless accepted in writing by our authorised representative.

17.8 Third-party rights. Except for Apple and its subsidiaries under Section 16.5, no person who is not a party to these Terms has a right to enforce them under the Contracts (Rights of Third Parties) Ordinance (Cap. 623), and that Ordinance is excluded to the extent permitted by law.
